U.S. Court of Appeals for the Eleventh Judicial Circuit

Various media outlets are reporting that Buju may be soon set free, however before we set a parade date let’s consider what is necessary to facilitate our hopes. Quoting the Jamaica Observer, it was reported on Wednesday, December 21, 2011 that “Violations of the act, such as where the state has failed to bring the case to trial for an ‘unreasonable’ length of time, may be a cause for dismissal of a criminal case.”

Buju’s attorney stated: “The prosecution will respond within the next 30-60 days and then we will file a reply. The court of appeals will then decide whether to have an oral argument on the case, which it will most likely set sometime in late summer. After that, it generally takes 6-9 months to get a decision. Sometimes even longer,”

In addition, The Court of Appeals must determine that an alleged violation of the constitutional right to speedy trial must be analyzed using the factors as set forth in Barker v. Wingo, 407 U.S. 514 (1972)

    . “Before getting to the four factors, the court must first determine if the delay is presumed to be prejudicial. A delay of more than one year from arrest to trial raises a presumption of prejudice to the defendant.” (1) the length of the delay; (2) the reasons for the delay and whether the delay is attributable to the state or defense; (3) the defendant’s assertion of the right to a speedy trial in due course; and (4) the prejudice to the defendant.

    Prejudice to the Defendant. The prejudice factor weighs “most heavily in determining whether a defendant’s constitutional rights have been violated. Simmons v. State, 290 Ga. App. 315 (2008). In evaluating any prejudice to the defendant, the court must consider: (1) oppressive pretrial incarceration; (2) anxiety and concern to the accused; and (3) the possibility of harm to the accused’s defense. The third factor is the most serious “because the inability of a defendant adequately to prepare his case skews the fairness of the entire system.” Harris v. State, 284 Ga. 455 (2008). Georgia courts have found that a delay of five years or more may lead to a finding of actual prejudice relieving the defendant of having to show specific prejudice in his case. Moore v. State, 294 Ga. App. 570 (2008). The Court of Appeals held that the trial judge in Moses did not abuse its discretion in finding either actual prejudice by the 48 month delay or specific prejudice because of the potential affect on the memory and credibility of alibi witnesses, nor was the judge wrong in finding actual prejudice by the 5 year delay in Pickett.

According to Vibe.com Buju will be released from prison soon, however it may take from 6-9 months minimum before a response is received. Although, we pray for Buju’s release six to nine months for a response at the least is not soon. As my father would say ” who feels it knows it”, as Buju already told you, “It’s not an easy road”. Jackie magazine, labeling pop singer Rihanna as the “ultimate n***ab*tch.”

After rabid responses from social media, fans, and Rihanna herself, Editor-in-chief Eva Hoeke has resigned. Hoeke claimed there was no racist motive behind the statement – and claimed it was meant as a joke. The publication has offered Rihanna a chance to express her feelings in their next issue. I wouldn’t hold my breath waiting for that invitation to be accepted. The audacity of this moralistically inept publication to issue a response such as, “it was meant to be a joke” constitutes another insult in itself.

Eva Hoeke quits as Editor-in-Chief of Jackie magazine

As a result of a recent publication in Jackie magazine, issue 49, a worldwide outcry arised over an article on page 45 entitled “De Niggabitch”, which refers to Rihanna and her fashion style. This word is used as slang in the United States.

Throughout the various social media there has been an emotional response to this choice of words, as published in Jackie. As a first reaction to this editor-in-chief Eva Hoeke said via Twitter that the choice of words was meant as a joke and offered an apology to anyone who felt offended. This reaction stirred up even more commotion, as Hoeke herself also referred to the term elsewhere in the magazine.

In a second reaction through Twitter, Hoeke came to the following conclusion: ‘1. Don’t publish bad jokes in the magazine 2. Don’t pretend bad jokes to be funny. Sorry guys. My bad.’ The response on social media now took on an international character. In a third reaction Hoeke even stated that she would rectify in the next issue of Jackie. This morning Rihanna replied on the article through Twitter. She was furious over the use of the word ‘niggabitch’ and ended her message with ‘Fuck you Eva’. Through social media Hoeke was taunted and threatened in various ways.

Following these events she consulted with publisher Yves Gijrath of GMG. Together they came to the following conclusion: In the interest of Jackie Magazine and all involved she will quit her job as editor-in-chief effective immediately. Hoeke states: ‘I realize that my first reaction through Twitter, in which I indicated that it was a joke, has been an incomplete misrepresentation what me, and also the author of the article, meant. The term ‘niggabitch’ came from America and all we did was describing a style of dress. Because of the enormous pressure through social media I was enticed to promise amendment regarding the linguistic usage in future issues of Jackie. Apart from that I also offered an rectification. I have now come to the conclusion that rectification is not the right solution. I regret that I have taken a stand too quickly regarding an article in Jackie — which moreover had no racial motive at it’s basis. Through the course of events, me and the publisher have concluded that because my credibility is now affected, it is better for all parties if I quit my job as editor-in-chief immediately. After putting my heart and soul into Jackie magazine for eight years, I realize that these errors – although without malicious intentions – are enough reason for leaving.’

Publisher Yves Gijrath regrets the state of affairs and praises Hoeke’s attitude, who primarily thinks of the credibility of the title, which – as she realizes herself – would have been damaged had she stayed. According to Gijrath there’s no doubt about the intentions and qualities of Eva Hoeke, however he does think this joint decision is the correct one. Hoeke concludes: ‘I should have counted to ten before taking unsubtle stands through social media channels. Through this my credibility has been hurt and that neither fits the role of an editor-in-chief, nor Jackie Magazine.

Jackie Magazine will invite Rihanna to share her feelings and thoughts on the article in the next issue.

First Gucci now a Dutch Magazine, it is obvious that Rihanna is experiencing some major hate.

Dutch magazine Jackie is under fire today for running an insanely inappropriate story about Rihanna’s evolving style titled “De Niggabitch.”

As quoted in the filthy and racist publication, “She has street cred, she has a ghetto ass and she has a golden throat. Rihanna, the good girl gone bad, is the ultimate niggabitch and displays that gladly, and for her that means: what’s on can come off. If that means she’ll be on stage half naked, then so be it. But Dutch winters aren’t like Jamaican ones [Ed. note: Rihanna is not Jamaican], so pick a clothing style in which your daughter can resist minus ten.

No to the big sunglasses and the pornheels, and yes to the tiger print, pink shizzle and everything that glitters. Now let’s hope she won’t beat anybody up at daycare.”

Rihanna’s response via twitter stated:

@evajackie I hope u can read english, because your magazine is a poor representation of the evolution of human rights! I find you disrespectful, and rather desperate!! You ran out of legit, civilized information to print! There are 1000′s of Dutch girls who would love to be recognized for their contributions to your country, you could have given them an article. Instead, u paid to print one degrading an entire race! That’s your contribution to this world! To encourage segregation, to mislead the future leaders to act in the past!

NEW YORK (December 17, 2011) – Across the Caribbean Diaspora, Jamaican promoter Walter Elmore’s Art of Music Productions (AMP) successful bid to attract mega star Celine Dion to the 2012 Jamaica Jazz and Blues Festival is being viewed as a boost for the festival and for the region.

Two years ago when the organization began its efforts to entice the musical icon to the festival, they had no idea how they could pull it off. “But I’m a firm believer that if you have an idea, you work at it. If you don’t try you’ll never succeed,” says Elmore, AMP’s chairman.

Inking the deal, Elmore says, took some “jumping through hoops” but now that all systems are set for Dion’s first performance in the Caribbean, he is understandably very excited. “Her production team is amazing and has been working with my team to make sure that everything’s in place. It is going to be an exceptional show,” he promises.

Canadian Celine Dion, one of the best selling female recording artistes of all time, is also excited about the opportunity to perform for her fans in the Caribbean. As she emailed to Elmore: “I am looking forward to doing my very first show in the Caribbean and this is an honor for me to perform at the Jamaica Jazz and Blues Festival. What a beautiful way to meet the people of Jamaica on this, my first trip to the island. I just can’t wait.”

Scheduled to perform on the Friday night of the festival, which runs from January 26 to 28, 2012, Dion is expected to woo her fans with classics such as: The Power Of Love; Because You Loved Me; All By Myself; I’m Your Angel; the Grammy and Academy Award-winning classic, My Heart Will Go On; and her breakthrough chartbuster, Where Does My Heart Beat Now.

In addition to Celine Dion, a dazzling lineup of top international, regional and local superstars has been announced for the three-day festival which takes place at the Trelawny Stadium.

International Grammy-winning reggae star Buju Banton claims in an appeal of his federal drug conviction there was not enough evidence to prove he was involved in a cocaine conspiracy. Mark Myrie a/k/a Buju Banton is trying to appeal a sentence of 10 years in a federal prison. Banton was recently sentenced in June for the intent to distribute cocaine. Banton’s gun possession charge was later tossed; however his attorney contends that the fight from Buju’s freedom is far from over and makes his argument why Buju’s sentence should be overturned.

The appeal filed Friday by attorney David O. Markus also says Banton was relentlessly pursued by a federal informant seeking a $50,000 government payday. Markus says that resulted in improper entrapment. Buju’s appeal was filed in the 11th U.S. Circuit Court of Appeals in Atlanta. Buju is currently serving his sentence in a penal facility in Miami Florida after United District States Magistrate James Moody sanctioned his move from minimum security facility in Texas. It has been reported that Buju is in better spirits since being relocated to the Federal Correction Institution (FCI-Miami). A three member panel of appellate judges in Georgia will decide if Buju’s case qualifies for an appeal. Approximately three-fourths of the court’s cases are decided on the briefs submitted by the parties, while the remaining cases include oral argument. Oral arguments are held in the Elbert P. Tuttle United States Court of Appeals Building in Atlanta, Georgia and are open to the public.

Rihanna in "Battleship"

Rihanna makes her acting debut in the movie “Battleship”, the 22 year old Bajan beauty and pop star is set to make her film debut in Peter Berg’s “Battleship” movie, set for release in May of 2012.

“Battleship” offers a fresh take on the classic board game, where naval forces unite on the high seas to battle an alien armada. Taylor Kitsch (“Friday Night Lights”) and Alexander Skarsgard (“True Blood”) have already been cast as two sailor brothers who partake in the fight.
